Three people have been charged in connection with a shootout that killed one and left shell casings scattered along nearly half a mile of Kathy Road on May 31.

Nathaniel James Tate, 37, and Nyzerion Ovarion Covington, 17, were each charged with attempted first-degree murder, according to publicly available court documents.
Jerry Jerome Benjamin, 53, was charged with discharging a weapon into an occupied property, court documents said.

The shooting left 34-year-old Gregory Adonis Rutherford dead and injured two others, including Benjamin. Benjamin was stable Tuesday, according to the Burke County Sheriff’s Office.
A copy of the arrest warrant for Tate said he tried to kill Jonathan Michael Benjamin, who was injured in the shooting but refused treatment, the Burke County Sheriff’s Office previously said.
A copy of the warrant for Jerry Benjamin says he fired a 12-gauge shotgun into a 2019 Chevrolet Tahoe while Tate and Covington were inside it.
Video from passersby showed federal marshals and local detectives surrounding a car on North Green Street near Independence Boulevard when they took Tate into custody.
Tate and Benjamin were initially were held without bond at the Burke County Jail, jail records showed.
